By accessing and using the TNT Farming Solutions website ("Site") and purchasing our products, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Site or purchase our products. TNT Farming Solutions reserves the right to modify these terms at any time, and your continued use of the Site constitutes acceptance of any changes.

TNT Farming Solutions manufactures and distributes organic fish fertilizer and biostimulant products, including OMRI Listed products for organic agriculture. All product information, including but not limited to descriptions, specifications, application rates, and images, is provided for general informational purposes. While we strive for accuracy, we do not warrant that product descriptions or other content on the Site is accurate, complete, reliable, current, or error-free. Product availability is subject to change without notice.

Orders placed through our Site or by phone are subject to acceptance by TNT Farming Solutions. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity. Prices are subject to change without notice. Payment is due at the time of order unless credit terms have been established with TNT Farming Solutions. We accept major credit cards, checks, and wire transfers as forms of payment.

We ship products throughout the United States. Shipping costs and delivery times vary based on destination, product weight, and shipping method selected. Title and risk of loss pass to the buyer upon delivery to the carrier. TNT Farming Solutions is not responsible for delays caused by carriers, weather conditions, or other circumstances beyond our reasonable control. Delivery dates are estimates only and we are not liable for damages resulting from delayed delivery.

Due to the nature of our agricultural products, returns are accepted only for products that are defective or damaged upon receipt. Claims for damaged or defective products must be made within 7 days of delivery. Returned products must be in their original, unopened containers. Refunds will be issued to the original payment method within 14 business days of receiving the returned product. Shipping costs are non-refundable. Products must be returned with prior authorization from TNT Farming Solutions.

All TNT Farming Solutions products must be used in accordance with the label directions and applicable federal, state, and local regulations. Users are responsible for reading and following all product labels, Safety Data Sheets (SDS), and application guidelines. TNT Farming Solutions is not responsible for improper use, application, storage, or handling of products. Results may vary based on soil conditions, climate, crop type, and application methods. We make no guarantees regarding specific yield improvements or outcomes.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TNT FARMING SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF CROPS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OUR PRODUCTS OR SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

TNT Farming Solutions warrants that our products conform to the chemical description on the product label and are reasonably fit for the purposes stated on the label when used in accordance with label directions under normal conditions. THIS IS THE ONLY WARRANTY WE MAKE, AND IT IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. We do not warrant against damage caused by factors beyond our control, including but not limited to weather conditions, soil conditions, pests, diseases, or improper application.

All content on this Site, including but not limited to text, graphics, logos, images, product formulations, and software, is the property of TNT Farming Solutions and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our express written permission.

Your use of our Site is also governed by our Privacy Policy. We collect and use personal information as described in our Privacy Policy. By using our Site, you consent to our collection and use of personal information as outlined in our Privacy Policy.

Our OMRI Listed products comply with USDA National Organic Program (NOP) standards. Users are responsible for ensuring that their use of our products complies with all applicable federal, state, and local regulations, including organic certification requirements. TNT Farming Solutions makes no representations regarding the suitability of products for use in specific organic certification programs beyond OMRI listing.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Ripley County, Indiana, and you hereby consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid, enforceable provision that most closely matches the intent of the original provision.
